Welcome to EduSoftHub. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and EduSoftHub ("we," "us," or "our") governing your access to and use of our school management software, mobile applications, website, and related services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service. Please read these Terms carefully before using our Service.
2 Acceptance of Terms
By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are entering into these Terms on behalf of a school, educational institution, or organization, you represent and warrant that you have the authority to bind such entity to these Terms, and "you" and "your" will refer to such entity.
3 Description of Service
EduSoftHub provides a comprehensive school management software platform designed to help educational institutions manage students, teachers, academic records, attendance, fees, examinations, and other administrative functions. Our Service includes:
- Web-based school management software
- Mobile applications for iOS and Android
- Cloud-based data storage and backup
- Customer support and training services
- Regular updates and feature enhancements
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, at our sole discretion.
4 User Accounts and Registration
To access certain features of our Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- Ensure that you are at least 18 years old or have parental consent
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.
5 Acceptable Use Policy
You agree not to use the Service to:

6 Payment Terms
6.1 Subscription Fees
Access to certain features of our Service requires payment of subscription fees. Fees are billed in advance on a monthly or annual basis, as selected during registration. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.
6.2 Price Changes
We reserve the right to modify our pricing at any time. Price changes will be communicated to you at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.
6.3 Payment Processing
Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method for all fees.
6.4 Refunds
We offer a 30-day money-back guarantee for new subscriptions. Refund requests must be submitted within 30 days of the initial subscription. After this period, fees are non-refundable except as required by applicable law.
7 Intellectual Property Rights
The Service, including all content, features, functionality, software, and materials, is owned by EduSoftHub and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with these Terms. This license does not include:
- The right to resell or sublicense the Service
- The right to modify, reverse engineer, or create derivative works
- The right to remove any proprietary notices or labels
- Any rights not expressly granted herein
All trademarks, service marks, and logos displayed on the Service are the property of EduSoftHub or their respective owners. You may not use any of these without our prior written consent.
8 User Content and Data
You retain ownership of all data and content you upload, submit, or create through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service.
You represent and warrant that:
- You own or have the necessary rights to all User Content
- User Content does not violate any third-party rights
- User Content complies with all applicable laws and regulations
- You have obtained all necessary consents for processing student data
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.
9 Service Availability and Modifications
While we strive to maintain high availability, we do not guarantee that the Service will be available at all times. The Service may be unavailable due to:
- Scheduled maintenance and updates
- Technical issues or system failures
- Force majeure events
- Third-party service disruptions
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any loss or damage resulting from such modifications or unavailability.
10 Termination
10.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon termination, your access to the Service will cease immediately.
10.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activities, or for any other reason at our sole discretion.
10.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account and data in accordance with our data retention policy. You are responsible for exporting your data before termination.
11 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties regarding the accuracy, reliability, or completeness of the Service
- Warranties that defects will be corrected
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
12 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EDUSOFTHUB, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Cost of substitute services
- Personal injury or property damage
- Any other damages arising from your use or inability to use the Service
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
13 Indemnification
You agree to indemnify, defend, and hold harmless EduSoftHub, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.
14 Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be resolved through:
- Good faith negotiation between the parties
- Mediation, if negotiation fails
- Binding arbitration in accordance with the Arbitration and Conciliation Act of India
- Courts of competent jurisdiction in Pune, Maharashtra, India
15 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending you an email notification (for significant changes)
- Displaying a notice in the Service
Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.
